1. SELLING COMPANY
SENSO is an online boutique managed by the company DOTX S.r.l.u. with registered office in Via Paolo da Cannobio 9, 20122 - Milan (Italy) VAT number / CF 03425010794, registered in the register of companies Milan Monza Brianza Lodi with REA number MI-2509327, telephone number 0240031827, e-mail address email@example.com (hereinafter "SENSO").
The terms and conditions (defined as "General conditions of sale") apply exclusively to the relationships between SENSO and its customers: subjects, natural and / or legal persons, who purchase the products offered in the online store www.senso. it (defined as "Products").
All orders are subject to the general conditions of sale in force at the time of each order, SENSO reserves the right to modify them, without notice, unilaterally and at its own discretion.
Customers are required to check the content of the aforementioned Conditions of Sale applicable to their order.
Any changes resulting from changes in the applicable legislation will be immediately effective, unless otherwise specified by the legislation in question.
2. PRODUCTS AND PRICE LIST
The prices of the Products include VAT (0%) and any other legal charges that may be due. The sale of refurbished electronic products is often subject to the margin tax regime.
If the price increases or decreases after the Customer confirms the order, before the order is confirmed and managed by SENSO, the Product is sold at the original price indicated in the order confirmation.
If the order undergoes changes, the price of the Product is equal to the price at the time of the change.
Delivery costs are included for standard shipments with fulfillment within 72 working hours, while “rocket” shipments with fulfillment within 24 working hours have an additional cost of 6.90 euros. UPS shipping is traceable on the courier's website, with standard UPS delivery times and possible delays for extended areas.
SENSO constantly checks the prices of the Products indicated on the website www.senso.it ; however, it is not possible to guarantee the absence of errors which, if necessary, will be communicated and managed within 48 hours of receipt of the order.
SENSO offers the Products for sale to natural and / or legal persons acting as consumers in accordance with the applicable legislation (hereinafter the "Customer" and, in the plural, the "Customers"), ie a natural person and / or legal acting for purposes unrelated to the resale and / or supply to third parties of the same products.
The consumer protection regulations in force in Italy apply to purchases made on the website www.senso.it, including in particular Legislative Decree no. 206 of 6 September 2005 ("Consumer Code").
At the time of ordering, the Customer is required to provide name and surname, complete shipping and billing address, an active telephone number and an e-mail address.
Customer data is stored in the SENSO Customer register and used solely to manage and maintain relations with the same.
4. CONCLUSION OF THE CONTRACT WITH THE CUSTOMER
The website www.senso-online.com shows the main information and the price of each Product. This information does not constitute an offer by SENSO.
Before sending an order proposal, the Customer is required to read all the instructions provided during the purchase procedure (also regarding any delivery costs, the conditions regarding the right of withdrawal and the Information on Privacy) as well as these General Sales Conditions
To purchase a Product, the Customer must (a) enter the selected Product in the "Shopping Cart" by clicking on the appropriate button, (b) fill in the order form, (c) select the payment method and delivery, (d) accept the General Conditions of sale (e) send the order proposal to SENSO through the website www.senso.it
The transmission of the order proposal constitutes a purchase proposal by the Customer relating to the selected Product, governed by these General Conditions and binding for the Customer (without prejudice to the right of withdrawal provided for in the following article 7).
The Customer can make any corrections / changes to the data entered before submitting the order proposal through the appropriate procedure indicated on the site.
The transmission of this order proposal by the Customer entails the obligation of the latter to pay the price of the ordered Product / Products ordered.
The contract between SENSO and the Customer is concluded when the latter receives confirmation from SENSO of the acceptance of the submitted order proposal.
The acceptance (or rejection) by SENSO of this proposal will be sent to the Customer at the e-mail address indicated in the order proposal (hereinafter "Order Confirmation"). p>
SENSO may refuse an order proposal (in this case no amount will be due by the Customer to SENSO) in the following cases:
(a) if the payment made by the Customer is not successful (by way of example, in the event of failure to charge the purchase price on the Customer's credit card);
(b) in case of unavailability of the Products;
(c) in case of non-fulfillment by the Customer of its obligations deriving from a previous contract concluded with SENSO.
(d) in the event that there is a report or suspicion of fraudulent or illegal activity.
The customer will be notified via email in case of unavailability of one or more Products. In this case, the order proposal is accepted only for the available Products, or canceled if there are none.
In compliance with the provisions of article 51, paragraph 7, of the Consumer Code, as well as of article 13 of Legislative Decree 70/2003, the Order Confirmation contains a summary of the main characteristics of the Products purchased, a detailed indication of the price and payment methods, information relating to any delivery costs, the conditions and methods for exercising the right of withdrawal, an indication of an address to which complaints can be made, and information on after-sales assistance services and on existing commercial guarantees.
The risk of loss or damage to the Products is transferred to the Customer when the latter (or a third party designated by the Customer and other than the carrier) materially comes into possession of the Product.
5. SHIPPING AND DELIVERY
The shipping methods currently available are available on the website www.senso.it
The costs for the "rocket delivery" of € 6.90 remain the responsibility of the Customer and are shown separately in the order form.
The delivery times of a Product purchased on the website www.senso.it indicated are indicative: they are based on the information provided by the logistics companies.
SENSO is not responsible for delays caused by unexpected changes applied by carriers beyond its control
Any damage to the packaging and / or the Product / Products or the mismatch in the number of packages or information must be immediately reported in writing on the Courier's delivery note.
The Courier's document has been signed without the Customer having raised objections, the latter will not be able to make any objection in this regard.
The Customer (or his delegate) is required to check, upon delivery of the Product or Products by the Courier:
(a) that the number of packages delivered corresponds to that indicated in the delivery note;
(b) that the packaging and its seals are intact, not damaged or altered in any way.
It is necessary to inform SENSO in writing of any objections via the email address firstname.lastname@example.org within 72 hours of receipt.
6. PAYMENT METHODS
The payment methods must be selected at the time of the conclusion of the order and it is not possible to modify them in any way once the order has been sent.
The Customer can pay by credit card, debit card, bank transfer (via SOFORT), ONEY / KLARNA.
SENSO accepts payments made using the following credit / debit cards: Visa, MasterCard, Maestro, American Express.
After selecting the method, the Customer will be directed to the payment provider page for processing the same and must follow the instructions provided.
Transactions will be debited to the Customer's credit / debit card only after (a) the credit / debit card details have been verified, (b) the authorization for the debit has been received of the company issuing the credit / debit card used by the Customer.
All payments can only be made in Euro currency.
The Customer therefore acknowledges and accepts that any surcharges on the exchange rate and any conversion fees established by the international circuits remain his sole responsibility.
SENSO issues electronic invoices if requested during the purchase phase.
Changes to the invoice are not allowed after its issue.
The Customer agrees to receive any courtesy invoice in PDF format by email.
7. RIGHT OF WITHDRAWAL FOR THE CONSUMER CUSTOMER
The Customer has the right to withdraw from the contract, without specifying the reason, within 14 (fourteen) days from the date on which the Customer (or his representative authorized to receive the Product) materially comes into possession of the Product itself following the purchase (Article 52 of the Consumer Code).
SENSO has chosen to offer its customers 16 additional calendar days as an extension for the right of withdrawal (for a total of 30 days).
If the customer does not use the return methods provided by SENSO, the costs for returning the Product are charged to the Customer.
The detailed instructions for returning the Products are in any case also available on the website www.senso-online.com
To exercise the right of withdrawal, the Customer must fill out the form at the following link https://nex-r.typeform.com/to/SUMHZC within the deadline set in the previous paragraph (30 days), or send the request by registered mail.
The Customer must return the purchased Product to SENSO following the instructions within 30 (thirty) days from the notice of withdrawal (sent in accordance with this article 7)
The Customer is solely responsible for any decrease in the value of the Product caused by its handling other than that necessary to ascertain its nature, characteristics and functioning. The Customer is therefore required not to remove any labels applied to the Product.
SENSO will refund in full the sums paid by the Customer without undue delay and in any case no later than 48 working hours after receiving the unlocked product as per the instructions provided in the withdrawal request.
This refund will be made by SENSO with the same payment methods used by the Customer for the initial transaction.
After the shipment of the Product, the order can no longer be canceled or modified.
The return of Products already shipped must in any case be carried out in accordance with the procedure provided for in this article 7.
8. CONFORMITY DEFECTS
The sale of the Products to consumer Customers is subject to the legal guarantees provided for by articles 129, 130,132 and 134 c.2 of the Consumer Code, taking into account the time of previous use of the products, limited to defects not deriving from normal use of the Products themselves. Pursuant to these regulatory provisions, the consumer customer has the right to obtain the restoration of conformity of the goods under warranty by repair or replacement, at no cost to him, or, in the event that one of these remedies is not successful (as provided Article 130, paragraph 7, of the Consumer Code), may obtain an appropriate reduction in the price of the Products or the termination of the contract.
The direct action to assert a lack of conformity not intentionally concealed by SENSO is prescribed, in any case, within 12 (twelve) months from delivery of the Product.
If the Customer requests the repair or replacement of the Product due to a lack of conformity in the terms referred to in this article 8, all delivery costs (return in the SENSO of the Product to be repaired or replaced, delivery to the Customer of the Product repaired or replaced) remain the responsibility of SENSO.
9. TERMS OF THE WARRANTY
Without prejudice to the rights of the Customers referred to in the previous article 8, SENSO also always provides a 12-month warranty on all phones, devices and other products. The detected defects are repaired by SENSO.
We offer 12 months free warranty on product and accessories.
The warranty period is 12 months, starting from the date of purchase. The warranty validity area is the country in which the phone was purchased, that is Italy.
The terms of the warranty separately specify which parts of the product, device or phone are not covered by the warranty.
If it is evident that the damage to the device was caused by the Customer, SENSO declines all responsibility. Such causes include, for example: material damage to the device, damage caused by liquids, misuse and negligence.
The warranty is excluded for:
- break or crack on the screen;
- damage reported by the product during shipment, if due to the negligence of the sender. Devices should always be protected and properly packaged as per the return instructions.
- removing viruses or malware from your phone;
- damage resulting from the use of an ungrounded socket to recharge the phone;
The warranty expires:
- in case of cutting the cables or opening the device;
- if the phone serial number or IMEI has been removed or made unreadable;
- if the body and / or the body of the device are broken, severely damaged or bent
- if a product purchased on SENSO has been repaired by the customer himself or entrusted to third parties for repair and / or replacement.
- if the device shows damage due to humidity.
The warranty does not cover indirect or merely economic damages caused by the breakage of the product, such as the loss of files.
Our warranty includes the following services:
- fast repair service guaranteed: start of the repair process within 48 working hours of receiving the phone / device;
- Device Replacement: If we are unable to restore the device to its previous condition, we will try to replace it with a matching model.
The warranty extension to 2 years is subject to the same terms and conditions and has an additional cost visible in the cart when purchasing the product.
SENSO warranty repairs are carried out within a maximum of 48 working hours from receipt of the device by the team of specialized technicians.
The Customer is required to inform SENSO of any defects as soon as they emerge. To do this, he can send an e-mail to email@example.com p>
After informing us and receiving instructions on how to proceed, the Customer must send the damaged Product to the address specified in the instructions, with the indicated delivery method.
To be able to intervene on the device and / or process it as a guarantee or return, it is absolutely necessary to deactivate the “Find my iPhone” function. The Customer is responsible for backing up the files on the device before sending it for repair.
If the device is returned with the wording "FRAGILE" (ie it must be handled with special measures) the shipping costs are charged to the customer.
10. PARTIAL REFUNDS
In case of missing or defective accessories, SENSO offers a gesture of goodwill according to the following amounts:
charger (without cable) 15 euros, charging cable 10 euros.
In case of aesthetic difference declared by the buyer between the ordered product and the received product, SENSO will have to check the discrepancy on the photos requested from the customer (screen on, screen off, back and all 4 edges of the product) .
SENSO will be able to offer a gesture of goodwill according to the following amounts:
A-AB 15 euros; A-B 30 euros; AB-B 15 euros; B-C 15 euros
A goodwill gesture of 15 euros can be offered to the customer in case the color is wrong.
Refunds of products under warranty issued by SENSO after the period of 30 days from the date of purchase may take into account the loss of value of the device. A loss of value equal to 5% each month is considered compared to the amount paid by the user during the purchase.
11.COSTS THAT MAY BE WITHDRAWN BY SENSO
In case of return for a refund, if the CUSTOMER does not return the accessories, SENSO can deduct the following amounts from the full refund:
Battery charger (without cable) 15 euros
10 euro charging cable
SENSO 10 euro piggy bank
12 ID AND PASSWORD
Some features or services offered on or through the site may require the Customer to register for the service (including setting the Apple ID and password). The Customer is solely responsible for managing the information on his account, including the password, confidentiality and data maintenance of his account. It is forbidden to use Apple IDs, passwords or accounts of other holders without the express authorization and consent of the holder of the account concerned. SENSO is not responsible for any loss or damage resulting from failure to comply with these obligations. SENSO is not responsible for forgetting the Apple ID or password. SENSO is not responsible for delivering the purchase receipt from the original owner of the phone to ensure the confidentiality of personal data.
13. INTELLECTUAL PROPERTY RIGHTS
“SENSO” is a registered trademark.
All illustrations, images, logos protected by copyright and, more generally, all intellectual property rights relating to the Products, accessories and packaging are and remain the exclusive property and / or availability of SENSO.
14. APPLICABLE LAW AND JURISDICTION
These general conditions of sale and the contracts concluded with customers are governed by Italian law and must be interpreted on the basis of it (including, for contracts concluded with consumer customers, Legislative Decree No. 206 of 6 September 2005 , "Consumer Code", as well as, in general, Legislative Decree no. 70 of 9 April 2003, "E-commerce Decree").
Any dispute arising from the interpretation, validity and / or execution of these General Conditions of Sale and of the contracts concluded with the Customers, will be devolved to the mandatory jurisdiction of the Court of Milan.
In any case, for any dispute that may arise, Customers will be able to activate an out-of-court dispute resolution procedure in compliance with the requirements set out in Articles. 141 and ss. of the Consumer Code.
In the event that the Customer activates the aforementioned procedure, SENSO guarantees its participation in an attempt at an amicable resolution that the Customer may promote before RisolviOnline, an independent and institutional service provided by the Arbitration Chamber of the Milan Chamber of Commerce.
The Customer can choose to access the platform for the extra-judicial resolution of disputes provided by the European Commission, available on the website http://ec.europa.eu/odr.
